Independent expert vs. insurer's expert — why independence matters

The other party's insurer likes to send its own expert. Why an independent expert is the better choice for you.

Whose interests does the insurer's expert represent?

An expert commissioned by the other party's insurer has a contractual relationship with exactly that insurer. Even with the best professional standards, there is a structural conflict of interest that can show up in conservatively assessed repair costs or diminished value.

The free choice of expert

Under § 249 BGB, as an injured party you may decide for yourself which expert to commission for the assessment. The other party's insurer cannot dictate an expert to you — even if some letters suggest otherwise.
